AOCAM WON THE HEARTS OF HOMELESS

5 th July,07. In the evening, the celebration took place in Asha Deep Apartments, Dwarka, Sector 2 where hundreds of members of various Group Housing societies gathered to express their appreciation towards Association of Co-operative Group Housing Society Affected Members(AOCAM) who created a history and won the hearts of thousands of homeless to get their sweet homes very soon. The grievances of more than ten thousand members of various Group Housing Societies in Dwarka got relief when Hon'ble High Court of Delhi took a major decision on 2 nd July,07 about Rule 24(2) of Delhi Cooperative Societies Rules, 1973 . The credit goes to AOCAM who tried its best under the capable leadership of Sh.DPS Rajesh and his entire dedicated team members. The homeless sufferers have to submit their documents within six weeks to claim their valid membership and they automatically will be able to get their flats. Yes off course one of the affected members was happy and expressed his views as dreams come true for him. “Undoubtedly, this is the best possible decision of the Hon'ble High Court” says Sh. The faith of thousands of members and their families of dozens of Group Housing Societies has shaken in the existing administrative dispensation of the Govt. of the NCT of Delhi as they feel deprived of their lawful right to have roof over their head. The office of the Registrar, Co-operative Societies, New Delhi has been making different alibis at different occasions for withholding of draw of lots for allotment of flats. The usual pretext for non-clearance of the list by the RCS office are investigation of 135 societies by the CBI, shortage of manpower, non compliance by the societies of Rule 24(2) of The Delhi Co-operative Societies Rules while enrolling members by them. As per provision of this rule, advertisements in two leading the newspapers - one in Hind and another in English - have to be issued and necessary procedure are followed before enrolling a member in the Society. It was stayed by the Hon'ble Delhi High Court in 1997. The factual position is that this rule 24(2) remained stayed till 6.7.2005 as per the records of the writ petition no.4130/97 titled Hind Co-op. G/H Society Ltd. and Other Vs. L.G. and other. This writ was disposed only on 7.7.2005.
Despite the stay in operation, The Registrar of Cooperative Societies erroneously issued a directive on 2.4.04 stating wrongly that the stay on rule 24(2) had been vacated on 8.1.03 due to the disposal of writ petition No. 4143/97 and 4130/97. The Registrar by this directive made it mandatory for the societies to comply with the provisions of rule 24(2). The fact remains that the writ number 4130/97 was never disposed on 8.1.03 and stay on operation of Rule 24(2) remained active till 6.7.2005. Unfortunately, the office of Registrar of Cooperative Societies harassed the members making wrong statement that their societies have not complied with the provisions of rule 24(2) and therefore, their membership is not valid. It is a case of administrative high handedness without any accountability. The Forum has documents in its possession which prove that the office of the RCS itself has allowed various persons enrolled as members in alleged violation of Rule 24(2) to get their flats allotted to them. It is a clear case of discrimination amongst members of the same class of societies without any valid reason.
Now members are distressed over the fact that the bureaucratic tangle has thrown their life in miserable condition so much so that they are unable to cope up with their different liabilities such as payment of EMI, maintenance of double establishment, debar from the benefit of income tax etc. This is only one aspect of the problems generated in the RCS office. Besides, the Forums feels that total inertia has gripped the RCS Office and even senior officers are shying away from carrying out their duties and responsibilities. The pending inquiries either by prosecuting agency or by the RCS office itself shall not be a ploy to delay/stop the work in that office. Instead of streamlining the work, the present RCS is issuing guidelines/orders which are not in conformity with his own orders issued previously. Latest in the series is an order passed canceling the earlier appointment of Returning Officers of 97 societies for conduct of elections. It is pertinent to note that these officers were appointed by the RCS and a large number of societies have already submitted their records to these officers for conduct of elections. Now by the latest order of the RCS himself all these appointments have been cancelled. Now a number of SDMs have been appointed as Returning Officers to hold elections of such societies. It seems, there is no system of checks and balances in the government of NCT of Delhi as far as the working of the Office of Registrar of Cooperative Societies is concerned.
The Forum has decided to launch fresh agitation on 12.2.2006 at Dwarka, New Delhi till the following demands are met by the concerned authorities of the Delhi Government:
Immediate issuance of administrative order nullifying the directive dated 2.4.2004 and holding all persons enrolled between 8.1.03 and 7.7.05 as bonafide members of the concerned societies;

Immediate issuance of directions to the Returning Officers to allow the persons enrolled between 8.1.2003 and 7.7.2005 their voting rights and their right to contest elections; and

Immediate clearance of the list of members by the RCS office for holding of draw of lots for flats.
